Terms of service

1. Scope

These terms apply to all screening services of PlotDossier, a brand of Ömer Kaşıkcı Şahıs Şirketi, Çeşme, Türkiye (“we”), for business customers (“customer”). Our services are not offered to consumers. Deviating terms of the customer apply only if we accept them in writing.

2. What we deliver

Depending on the package: a geometry check of the plot data supplied by the customer against the published rules of the EU Information System (TRACES); a GeoJSON file of the plots that pass this check; a screening of each plot against open satellite and forest datasets (e.g. JRC Global Forest Cover 2020, Hansen Global Forest Change, ESA WorldCover, Copernicus Sentinel-2) for indications of forest loss after 31 December 2020; a risk flag per plot (LOW / REVIEW / HIGH); a PDF report, a CSV summary and an audit log. The scope, price and delivery time of each order are stated in our written quote or order confirmation.

3. Screening, not certification, not legal advice

Our results are technical screening results. They are not a certification, not an official survey, not an approval by any authority and not legal advice. In particular, we do not assess the legality of production under the laws of the country of production, and we do not confirm that a product meets the requirements of Regulation (EU) 2023/1115 (EUDR). A “TRACES-ready” or “geometry-checked” file means that the geometry meets the published format rules at the time of delivery; it does not guarantee acceptance of a due diligence statement.

4. Customer’s responsibility

The customer remains solely responsible as operator or trader under the EUDR: for the due diligence, the risk assessment and mitigation, the due diligence statement (DDS), the submission in TRACES and the decision to place products on the market. The customer is responsible for the correctness and completeness of the data supplied (locations, areas, producers, commodity) and for having the right to pass on personal data of producers to us.

5. Limits of satellite data

Open satellite and forest datasets have a resolution of 10–30 m, contain classification errors and can be affected by clouds, seasons, shade-grown crops and plantations. A LOW flag does not prove the absence of deforestation; a HIGH flag does not prove deforestation. REVIEW and HIGH plots are looked at by a surveying engineer; the result is a professional assessment based on the available data, not a field inspection.

6. Cooperation and delivery time

Delivery times (e.g. two working days for up to 50 plots) start when complete and usable data has been received. If data is missing or faulty, we inform the customer and the delivery time is extended accordingly.

7. Prices and payment

Prices are in EUR and net. For business customers in the EU the reverse-charge procedure applies (Art. 196 Directive 2006/112/EC); the customer provides its VAT ID. Invoices are payable within 14 days by bank transfer to: Türkiye Garanti Bankası A.Ş. (Garanti BBVA), IBAN TR82 0006 2000 4900 0009 0888 96, SWIFT/BIC TGBATRIS, account holder Ömer Kaşıkcı. Bank charges of the sending bank are borne by the customer (SHA/OUR). The free 3-plot trial is free of charge and without obligation; one trial per company.

8. Rights of use

The customer may use the delivered files and reports without restriction for its own due diligence, its records and for passing them to authorities, auditors and business partners. Third-party data credits (e.g. “Contains modified Copernicus Sentinel data”) must not be removed.

9. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of essential contractual obligations, limited to the typical, foreseeable damage and in any case to the fee paid for the order concerned. We are not liable for fines, confiscation, rejected due diligence statements or lost business resulting from the customer’s own decisions under the EUDR.

10. Confidentiality and data protection

We treat customer data confidentially and use it only for the order. Where we process personal data on the customer’s behalf, we conclude a data processing agreement under Art. 28 GDPR on request. See our privacy notice.

11. Governing law and jurisdiction

These terms are governed by Turkish law. Place of jurisdiction is İzmir, Türkiye. Should a provision be invalid, the remaining provisions stay effective.

12. Language

These terms are available in English and German. Both versions are equally binding.
